How we Use Information

In addition to the uses described elsewhere in this Privacy Policy, we may also use your personal information for the following purposes:

We use all information provided to assist us with the development and improvement of our Site, services, tools and associated technologies, and to develop new services, features and functionality, including through third parties such as contractors, sub-contractors and service providers.

We may use personally identifiable information and other information internally – for example, to help diagnose problems with our services, to make our services more useful for you and for our other customers, to develop new services, features, and functionality, and to offer and grant you access to other sites and services We operate and provide.

By analyzing all information we receive, we may compile statistical information across a variety of users (“Statistical Information”). Statistical Information helps understand trends and customer needs so that new services can be considered and so our services and associated technology and services can be tailored to customer desires. We may share non-personal Statistical Information with our partners, pursuant to commercial terms that we determine in our sole discretion. In addition, we may provide any information to third parties, so long as we have removed any information that identifies any specific individual or user, such as a name, address or contact information.

We may use your information to contact you for administrative purposes such as customer service or to provide promotional messages. We may use your information in order to provide you with information or promotions that we believe you may be interested in, however you will always have the possibility to opt-out from direct communications containing commercial messages.

We may also use your information to conduct tailored advertising, to assess our marketing campaigns performance, to track referrals made through this Site or through our ads placed on other websites or mobile applications, and to validate you as a human and not a bot.

We may use analytics tools, including Google Analytics. These tools help us understand users’ behavior on our Site and services, including tracking page content, and click/touch, movements, scrolls, and keystroke activities. The privacy practices of these tools are subject to their own policies and they may use their own cookies to provide their services. Click here for further information about Google cookies. Click here to opt-out of Google Analytics.

We may provide you with the ability to transfer your information to services or websites provided by third parties. If you approve, by clicking the link to such websites or services, we may transfer all or any of your information we have collected (including information that personally identifies you) to such services or websites. If you do not wish for your information to be transferred in such manner, you should refrain from clicking through links we provide to such services.

We will only use collected information in compliance with applicable law.

Cookies

We may use cookies, web beacons, gifs, pixel tags, log files or other industry-recognized technologies to automatically collect certain information when you use our Site and services (collectively, “Cookies”) in order to help us learn about how you use the Site and services and enhance your online experience. We may also use Cookies (including Cookies provided by third parties) to conduct tailored advertising across unaffiliated ages or mobile application.

Cookies are small text files containing strings of information that are locally stored on your computer or mobile device. They are widely used in order to make websites work, or work in a better, more efficient way. They can do this because websites can read and write these files, enabling them to recognize you and remember important information that will make your use of a website more convenient (e.g. by remembering your user preferences).

Check the “Help” menu of your browser or operating system to learn how to adjust your tracking settings or cookie preferences. Note that our system may not recognize some or all “Do Not Track” headers from browsers.

How we Protect Information

We follow generally accepted industry standards to protect the data submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your information, we cannot guarantee its absolute security.

Sharing Your Information with Third Parties

Notwithstanding anything to the contrary herein, we will fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity, behavior, or digital content of any user suspected to have engaged in illegal or infringing behavior. We will comply with any applicable law that requires the collection and provision of your data to the applicable authorities.

We may use subcontractors and third-party service providers and send them the information we receive for the purposes set forth in this Privacy Policy. We may also share your information with our subsidiaries, parents, and/or affiliates for purposes consistent with this Privacy Policy. All of the above may be located in countries other than your own. For example, we may send your information to any countries outside the United States or the European Economic Area. All our subcontractors will be subject to non-disclosure and non-use obligations. Nevertheless, some countries to which your information may be transferred may have levels of protection of personal and other information which are not as high as in your country of residence or business.

We may disclose data and information as necessary for us to enforce our agreements and policies, investigate any claims against NowInSports, and protect the rights and property of NowInSports or its agents, employees, and customers. We may disclose data as we reasonably believe necessary to investigate and protect the security of our software, servers, and other equipment. We may disclose or transfer data and information in connection with a sale of all or part of our business or assets, in the event of a change of control of NowInSports (or any negotiation process with respect to these events), or in the event of an insolvency, bankruptcy, or receivership in which information is transferred to one or more third parties as one of our business assets.

We disclose data and information to our clients, third-party marketing platforms, publishers, and service providers to assist us in conducting tailored advertising, including without limitation in order to display ads on our behalf on unaffiliated web domains or applications based on preference or interests known or inferred from the data we collect from you. In addition, such disclosure of data allows us to perform cross-device linking (i.e. allowing us to link two or more devices that are believed to belong to the same user for tailored advertising purposes).

We may share information (including not identified information and email address) with third-party platforms for marketing and operation purposes. Such social media platforms may collect your personally identifiable information independently and may combine the information provided by us, with your personally identifiable information which they collect on their own behalf from you and to which you gave your separate and independent consent directly to them. Any such action and any personally identifiable information that may derive from it is subject to the third party’s own privacy policy and is not governed, controlled, or known by us.

Children

NowInSports does not knowingly collect personally identifiable information from individuals under the age of 21.

Third Parties

This privacy policy does not cover information that you may independently provide to third parties by using links to third parties which may exist on our Site. Please check the privacy policy of any such third party in order to understand how they use, collect and store your information.

Privacy Notice for California Residents.

Our California Do Not Track Notice. Some web browsers offer a “Do Not Track” (“DNT”) signal. A DNT signal is an HTTP header field indicating your preference for tracking your activities on Our Service or through cross-site user tracking. We do not currently respond to DNT signals. We may allow third parties, such as companies that provide us with analytics tools, to collect Personal Information about an individual consumer’s online activities over time and across different web sites and services when a user uses Our Services.

In some instances, the California law may apply to our data sharing. If you are a California resident, this section may apply to you and supplement the main privacy policy. The California Consumer Privacy Act (CCPA) provides specific rights to California residents in relation to their personal information. As a California resident and to the extent provided by law, you may:

  • Request to Know/Access. You have the right to know what information we have collected, used, disclosed, or in the preceding twelve (12) months. Please read the sections above: ‘Information We Collect’, ‘How We Use Information’, and ‘Sharing Your Information with Third Parties’, to exercise this right. We will also disclose to you the specific pieces of personally identifiable information that we collected about you if we receive your request for such information at [email protected] and verify your identity.
  • Request to Deletion. You have the right to request that we delete from our databases any of your personally identifiable information that we collect and retain, subject to certain exceptions (such as detecting security incidents, debugging, comply with legal obligations, etc.). We will delete your personally identifiable information from our records once we receive your request at [email protected], verify your identity and ensure that no exception applies.
  • No Discrimination. We will not discriminate against you for exercising your above rights, by: (A) denying you goods or services; (B) charging you different rates for goods or services; (C) providing you with a different level or quality of goods or services; or (D) suggesting that you will receive a different price, rate, level, or quality of goods or services. We may have a different rate or provide a different level or quality of service if the difference is reasonably related to the value provided to you by your personally identifiable information we collect.
  • Handling Privacy Requests. We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If the exercise of your right requires more time (up to 45 additional days), we will inform you of the reason and extension period in writing. We may deny your request if we could not verify your request or if we must retain your personal information for certain activities (such as detecting security incidents, debugging, comply with legal obligations, etc.).
  • Request to Opt-Out from Sale of Personal Information. Though we do not currently sell personal information, the California Consumer Protection Act may consider some of our use of cookies as a “sale” of personal information. As a California resident, you may click the “do not sell my personal information” link at the bottom of our homepage and opt out of such a “sale” of information to third parties. When you opt-out, you may still see general audience advertising regarding Our Services.
